Warranty

I. LIMITED WARRANTY

This is a “Limited Warranty” which gives you specific legal rights. You may also have other rights, which vary from jurisdiction to jurisdiction. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitation or exclusion under this Limited Warranty may not apply to you. Please keep your dated sales receipt; it is required for all warranty requests. Any dispute or controversy regarding this Limited Warranty arising from your use of your STRAQ products will be resolved by final and binding bilateral arbitration in accordance with the “Dispute Resolution” section of the Terms of Service, found here.

1. WHAT THE WARRANTY COVERS

For a period of one (1) year from the date of purchase of your STRAQ product, or one (1) year from the date of receipt of your replacement STRAQ, RTMS Ltd (“STRAQ”) will, at its sole option, repair or replace any STRAQ products that malfunction due to defective parts or workmanship no charge to you. This warranty is not transferrable and applies only to the original consumer purchaser. STRAQ may, in its sole discretion, make any repair or replacement with new or refurbished product or components. If the product or component requiring repair or replacement is no longer available, STRAQ may, in its sole discretion, replace such product with a similar product of similar function.

2. WHAT THE WARRANTY DOES NOT COVER

Repair service, damage due to misuse, abuse, negligence or casualty (e.g., fire), acts of God (including but not limited to lightning, flood, tornado, earthquake, or hurricane), and consumable parts (including batteries) are not covered by this warranty. Damage from unauthorized service or modification of the product or of any furnished component will void this warranty in its entirety. This warranty does not include reimbursement for inconvenience, installation, loss of use, or unauthorized service. In addition, this warranty does not cover any losses, injuries to persons, loss of property or general damages. This warranty, our theft protection, and community support services do not apply to any products purchased from third party sellers on eBay, and other online marketplaces. We strongly suggest that you do not buy STRAQ products from any unauthorized sellers, as such products may be used, defective, counterfeit or may not be designed for use in your country. This warranty covers only STRAQ products and is not extended to other equipment, components, or devices that a customer uses in conjunction with our products. STRAQ’s maximum liability under this warranty is limited to the original purchase price of the STRAQ product in question.

THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY, REPRESENTATION OR CONDITION OF MERCHANTABILITY OR THAT THE PRODUCTS ARE FIT FOR ANY PARTICULAR PURPOSE OR USE, AND SPECIFICALLY IN LIEU OF ALL SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES. IF RTMS LTD CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES, THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY AND TO REPAIR OR REPLACEMENT SERVICE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG A STATUTORY OR IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. REPAIR OR REPLACEMENT SHALL BE THE SOLE REMEDY OF THE CUSTOMER AND THERE SHALL BE NO LIABILITY ON THE PART OF RTMS LTD FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOSS OF BUSINESS OR PROFITS, WHETHER OR NOT FORESEEABLE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.

This limited warranty gives you specific rights. You may have additional rights under applicable law, and this limited warranty does not affect such rights.

II. How to obtain service / replacement

To obtain the benefit of the above limited warranty, please contact STRAQ community support at: help@rtms.limited

For warranty requests: Please be prepared to describe the product that needs service, the nature of the problem and to provide proof of purchase. You will also be required to return your existing device in accordance with directions that will be provided by STRAQ. STRAQ has no warranty obligations with respect any products that are excluded from warranty pursuant to Paragraph 2 above, as reasonably determined by STRAQ, and the owner of such device shall bear all shipping costs for the return of such product to owner. Any claim under this Limited Warranty must be submitted to STRAQ before the end of the warranty period described above. Please allow up to fourteen (14) business days for your warranty request to be processed. For replacement requests: Please be prepared to describe the product that needs to be replaced and a copy of the police report. Please allow up to fourteen (14) business days for your replacement to be processed.

BACKGROUND

RTMS Ltd understands that your privacy is important to you and that you care about how your personal data is used. We respect and value the privacy of all of our customers, suppliers and employees and will only collect and use personal data in ways that are described here, and in a way that is consistent with our obligations and your rights under the law. This Privacy policy has been written in line with the new General Data Protection Regulation that comes into effect on 25th May 2018. For the purposes of GDPR we, Real Time Logistics Solutions Ltd, are the data controller.

2. What Does This Notice Cover?

This Privacy Information explains how we use your personal data: how it is collected, how it is held, and how it is processed. It applies to all products and services, and instances where we collect your personal information. This information can be provided to us through email, telephone, face to face or any other means we interact with you. It also explains your rights under the law relating to your personal data.

Personal data is defined by the General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’. a) The right to be informed about our collection and use of your personal data. This Privacy Notice should tell you everything you need to know, but you can always contact us to find out more or to ask any questions using the details in Part 11.

b) The right to access the personal data we hold about you. Part 10 will tell you how to do this.

c) The right to have your personal data rectified if any of your personal data held by us is inaccurate or incomplete. Please contact us using the details in Part 11 to find out more.

d) The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of any of your personal data that we have. Please contact us using the details in Part 11 to find out more.

e) The right to restrict (i.e. prevent) the processing of your personal data.

f) The right to object to us using your personal data for a particular purpose or purposes.

g) The right to data portability. This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases.

6. How Do You Use My Personal Data?

Under the GDPR, we must always have a lawful basis for using personal data. This may be because the data is necessary for performance of a contract, because you have consented to our use of your personal data, or because it is in our legitimate business interests to use it. Your personal data may be used for one of the following purposes:

  • To carry out our obligations arising from any contracts entered in to between you and us and providing a service.
  • To ensure we can communicate with you on orders placed on technical issues.
  • To send invoices and statements.

  • Purchase of services and supplies.
  • To maintain up to date details

7. How Long Will You Keep My Personal Data?

We will not keep your personal data for any longer than is necessary in light of the reason for which it was first collected for reasonable business needs including managing our ongoing relationship. We will undertake yearly reviews of the data we hold and any data no-longer required will be disposed of in a managed and secure way.

8. How and Where Do You Store or Transfer My Personal Data?

We will only store or transfer your personal data in the UK. This means that it will be fully protected under the GDPR. We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you of a suspected data security breach where we are legally required to do so. You are responsible for your contact information to us and you should notify us immediately of any unauthorised use of your emails, for example.

9. Do You Share My Personal Data?

We will not share any of your personal data with any third parties for any purposes, subject to one important exception detailed below. In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority such as HMRC.

10. How Can I Access My Personal Data?

If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”. All subject access requests should be made in writing and sent to the email or postal addresses shown in Part 11. There is no charge for a subject access request. However, if we deem your request to be ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding of £15 plus VAT. We will respond to your subject access request within 4 weeks of the date of receiving the request. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

We may change this Privacy Notice from time to time. This may be necessary, for example, if the law changes, or if we change our business in a way that affects personal data protection. Any changes will be made available via the website www.rtlsgroup.com This Privacy notice was updated in May 2018.

Please let us know if you are unhappy with how we have used your personal information. You can contact us as detailed in section 11.

Further information about your rights can also be obtained from the Information Commissioner’s Office or your local Citizens Advice Bureau. You also have the right to complain to the Information Commissioners Office. You can find out on their website how to report a concern.
